Civil Judgment Collections
We don't get paid unless we collect!
How it works
When a civil case is reduced to and enforceable civil judgment, the judgment becomes a financial debt instrument which can be bought or sold. Most traditional debt collection agencies purchase debt instruments outright, buying in bulk, and paying around 4-7 cents on the dollar. This doesn't leave much for the debt seller. Morgan Financial Group is different. We will purchase your judgment for 50 cents on the dollar, but we purchase judgments on a "contingency" basis.
What this means is that you enter into a contractual agreement with us which basically stipulates that there is no cost to you, you are the original creditor, and that our agreement is a 50-50 sharing of what we are able to recover. We will also provide you a legal form for your signature, called "Acknowledgement of Assignment of Judgment". This form is docketed with the court and transfers ownership of the judgment to us, allowing us to pursue enforcement Pro se (a Latin phrase meaning "for oneself" or "on one's own behalf").
Upon taking ownership of the judgment, we begin an exhaustive search for the judgment debtor's assets. To that end, we routinely bring the debtor back into court for a court involved debtor examination or even depose third parties who may have information about the debtor's finances. We also use a combination of private investigative resources at our disposal, including limited access databases, surveillance of the debtor and other forms of field investigations. If the debtor has assets we will locate them.
When the asset investigation is complete and assets are located, enforcement procedures are commenced. Enforcement proceedings may include but are not limited to:
-
Real estate liens and forced sales
-
Bank levies and garnishments
-
Wage Garnishments
-
Assignment orders
-
Personal and commercial property seizures
-
Till levies
-
Turnover orders
After money is recovered, it must by law remain in a trust account for 90 days at which point your share is distributed to you. If we are unable to collect (ie. the debtor has no assets, the debtor had the judgment discharged in bankruptcy court, or the debtor moved out of the country, etc.) you owe us nothing.
To move this forward we only need your signature on a few forms. Then all you need to do is sit back, wait, and let us do our work. Please feel free to contact us at any time to discuss your judgment.
